Anaphylaxis Get Nationally Acclaimed Legal Representation

Nationwide Anaphylaxis Lawyers in Vaccine Injury Cases

Anaphylaxis is a severe, potentially life-threatening allergic reaction that can occur rapidly, often within minutes of exposure to an allergen. The reaction can cause a range of symptoms, from mild to critical, involving multiple body systems. Swift medical intervention is crucial to manage the symptoms and prevent fatal outcomes. Common triggers include foods, insect stings, medications, and vaccines.

Anaphylaxis resulting from a vaccine occurs when the body's immune system has an extreme and adverse response to a component of the vaccine. This reaction is rare but serious, requiring immediate treatment.

If you or someone you love has been vaccine-injured with anaphylaxis, you can turn to Jeffrey S. Pop & Associates. Our accomplished legal team has exclusively focused on vaccine injury representation for decades, resulting in a track record of success.

We are well-equipped to help you file a claim through a federal no-fault program that provides compensation for medical expenses and other damages. With a 90% success rate, we have become a top choice for the vaccine-injured and their families across the U.S.

What Are the Symptoms of Anaphylaxis?

Anaphylaxis is characterized by a broad range of symptoms that can vary in severity, often developing rapidly after exposure to an allergen.

Common symptoms include:

  • Respiratory problems: Difficulty breathing, shortness of breath, wheezing, nasal congestion or throat tightness.
  • Skin reactions: Hives, itching, rashes, and skin flushing.
  • Gastrointestinal issues: Nausea, vomiting, diarrhea, and abdominal pain.
  • Cardiovascular problems: A rapid or weak pulse, low blood pressure, and fainting or collapse.
  • Neurological symptoms: Dizziness, confusion, and a sense of impending doom.
  • Swelling: Swelling of the face, lips, tongue, or throat, which can obstruct the airway and make breathing difficult.

Swift recognition of these symptoms and prompt treatment with epinephrine are essential to mitigate the severe complications of anaphylactic shock. Epinephrine is crucial for treating severe allergic reactions. It is a naturally occurring hormone and neurotransmitter produced by the adrenal glands, playing a central role in the body's fight-or-flight response.

Epinephrine works by constricting blood vessels, which helps increase blood pressure and relax the muscles in the airways, making breathing easier. It also reduces swelling and hives. The medication is often delivered via an auto-injector (such as an EpiPen) for quick and easy administration, providing rapid relief from potentially life-threatening symptoms.

Vaccines Linked to Anaphylactic Shock

Anaphylactic shock is a severe and life-threatening condition that occurs when anaphylaxis progresses rapidly, causing an extensive response from the body's immune system. This intense reaction can lead to loss of consciousness. Immediate medical intervention is critical to prevent fatal outcomes. Several vaccines have been associated, though rarely, with anaphylactic reactions.

These include but are not limited to:

  • MMR (measles, mumps, and rubella) vaccine
  • Influenza vaccine
  • Hepatitis B vaccine
  • HPV (human papillomavirus) vaccine
  • Tetanus, diphtheria, and pertussis (Tdap) vaccine

Treatments for Anaphylactic Shock

As mentioned above, immediate treatment with epinephrine is needed. Further medical care can include antihistamines to reduce itching, swelling, and other allergic symptoms. Corticosteroids may be used to reduce inflammation and stabilize the immune response. Oxygen therapy can alleviate breathing difficulties, and intravenous fluids can maintain blood pressure and hydration.

Patients who experience anaphylaxis will often be monitored closely in a medical setting until their symptoms are entirely under control.

Injury Claims Through the National Vaccine Injury Compensation Program

If you or a loved one has suffered anaphylaxis due to a vaccine, you may be eligible for compensation through the National Vaccine Injury Compensation Program (VICP). Compensation can include medical expenses, lost wages, pain and suffering, and legal fees.

To file for a claim, detailed medical records must be submitted showing the onset and severity of the anaphylactic reaction after vaccination, along with proof of vaccination. Statements from healthcare providers linking the reaction to the vaccine should support your claim.

Additionally, you must submit documentation of all your medical costs and related expenses incurred due to your injury. Evidence that symptoms appeared within a medically accepted timeframe following vaccination must also be submitted.

Common Answers To Your Questions

Have questions? We are here to help. Still have questions or can't find the answer you need? Give us a call at 888-891-2816 today!

  • What is a Vaccine Injury?

Vaccine injuries refer to any adverse events that are caused by avaccination. For instance, a vaccine injury can be caused by the wrongful administration of a vaccine. Alternatively, an autoimmune response to the ingredients of the vaccine may cause an adverse event. These types of adverse reactions are rare, but at times painful or quite serious and potentially even catastrophic.

  • How to File a Vaccine Claim?

An individual can file a claim without legal representation. The government utilizes Department of Justice (DOJ) attorneys who defend each case. Therefore, it is wise to retain an experienced and reliable vaccine injury attorney to assist you through the process and who can make sure the rules and guidelines of the court be followed that the Special Masters (Judges) require.

  • How Common Are Vaccine Injuries?

Vaccine injuries are rare when considering the number of vaccinations given nationwide. According to the Vaccine Injury Compensation Program (“VICP”) statistics, less than 1% of vaccine doses result in adverse reactions. Many of these are not compensated since the adverse reaction lasts less than six months. Notwithstanding, many vaccine injuries are legitimate and must be fairly compensated.

  • What Vaccines Are Covered by the National Vaccine Injury Compensation Program?
  • What Can I Get From a Vaccine Claim?

The compensation under the law includes pain and suffering, loss of earnings, reimbursement of out-of-pocket expenses (not reimbursed by insurance), as well as past and future life care plan costs including attendant care, home modifications, and adaptive devices as required. Additionally, no attorney’s fees or cost are charged to the injured party (Petitioner).

  • What is a Vaccine Injury Lawsuit?

There are two types of lawsuits possible for a vaccine injury.

    1. The most common is a Petition (complaint) filed before the United States Court of Federal Claims (”USCFC”) in Washington D.C. These cases are always defended by the Department of Justice (DOJ) attorneys in the Vaccine Division. The DOJ employs approximately 35 attorneys. The Vaccine Division of the USCFC has 8 full-time Special Masters (Judges) who hear these cases. To file a federal case under the Vaccine Injury Program, it is wise to retain an experienced vaccine law firm to assist you as many cases need to be supported by expert medical testimony in order to succeed. Additionally, experienced attorneys know the potential value of a case when weighing the risk and likely compensation during settlement negotiations.

    2. The second type of vaccine lawsuit is under State Law for products liability, or personal injury. It involves paying the cost for experts and depositions and varying legal standards. It may be more difficult to prove with respect to those vaccines not covered by the Vaccine Injury Compensation Act. For now, the traditional court system may be the only legal recourse available for non-covered vaccines. The exception to this is for Covid-19 cases. Sadly, Covid-19 cases are covered by the very restrictive Countermeasures Injury Compensation Program (CICP) which is nonjudicial. Our law firm does not represent individuals in any administrative nonjudicial program.
